The COFI Shift: What It Means for Your Daily Workflows
The COFI Transition: Redesigning Day-to-Day Operations for Principles-Based Compliance
For nearly a decade, South African financial institutions have been preparing for the shift toward the Conduct of Financial Institutions (COFI) Bill. High-level briefings, board-level risk reviews, and legal impact assessments have dominated executive agendas.
However, as the regulatory framework moves closer to full implementation under the FSCA’s multi-year plans, a critical shift is happening inside banks and financial services providers (FSPs): the burden of compliance has officially moved from the legal office into operational units.
For middle and senior managers, those running credit divisions, customer onboarding, claims processing, and wealth management teams, the question is no longer “What is COFI?”
The real question keeping leaders up at night is as follows: “How do I run my department on Monday morning under a principles-based regime?”
From Static Policies to Living Evidence
Under traditional rules-based frameworks, compliance was often treated as an exercise in ticking boxes: Did we send the disclosure document? Did the customer sign on line X? Is the policy saved in the directory?
COFI fundamentally changes this dynamic. By shifting to a principles-based, activity-focused model, regulators care far less about static policy documents and far more about demonstrable customer outcomes.
For line managers, this creates a significant operational execution gap:
- Traditional Approach: “We have a Treating Customers Fairly (TCF) policy.”
- The COFI Approach: “Here is the operational Management Information (MI) showing our product design, dispute resolution speed, and fee structures consistently deliver fair outcomes for customer cohort Y.”
If your front-line team cannot demonstrate how their daily routines uphold these outcomes, your organisation remains exposed to conduct risk, regardless of how polished your board-approved policies might be.
3 Practical Workflows to Be Redesigned Now
To successfully operationalise COFI, middle and senior management should audit and adapt three core areas within their teams:
1. Front-Line Decision-Making & Scripting
Static, automated call-centre scripts and rigid decision trees must evolve. Front-line staff need the training, capability, and autonomy to evaluate whether a product or process is genuinely suitable for the client in real-time, rather than strictly following a rigid flowchart.
2. Management Information (MI) & Conduct Metrics
Operational reporting can no longer focus solely on volume, speed, and sales targets. Line managers must integrate conduct metrics into daily dashboards, such as customer friction rates, turnaround times on complaints, and product drop-off points, to detect bad customer outcomes early.
3. Activity-Based Process Mapping
Due to COFI licenses activities rather than traditional institutional silos, managers need to map team tasks (e.g., advising, distribution, execution of orders, or payment services) directly against the specific regulatory standards for those activities.
Bridging the Gap: The Role of Capability Building
Navigating this transition requires more than just updated Standard Operating Procedures (SOPs). It demands a cultural and capability shift across every layer of management. Line managers are the vital bridge between high-level executive risk appetites and daily employee behaviour.
Organisations that succeed under COFI won’t just be those with the best legal teams; they will be the ones that invest heavily in upskilling their operational managers to lead with conduct in mind.
